COVERAGE HIGHLIGHTS
This facility provides coverage for liability arising out of a negligent act, error or omission in rendering professional services. This facility is for independent testing laboratories involved in rendering professional services in the disciplines of:

Our program will not cater to Testing Laboratories in disciplines as follows:

The coverage provided by this insurance Policy shall not apply to:
| (a) |
The actual, alleged, or threatened discharge, dispersal, release or escape of pollutants, such as solid, liquid, gaseous or thermal irritants or contaminants, including smoke, vapor, soot, fumes, acids, alkalis, chemicals, and waste (waste include materials to be recycled, reconditioned, or reclaimed; or

| (b) |
Any government or regulatory directive or request that the Insured or anyone acting under its direction or control test for, monitor, clean up, remove, contain, treat, detoxify or neutralize said pollutants, providing always that this exclusion shall not apply to any claim or “costs, charges, or expenses” arising out of any negligent act, error, or omission made by the Insured:

(i) |
in the analysis of materials or samples which contain “pollutants” and the presence of which is not detected by the Insured, or
|
(ii) |
if the type, level, concentration, or any other aspect of the “pollutants” is erroneously made, and as a result of which, a written report or opinion is rendered by the Insured containing such error or omission and, as a further result of which the Isnured’s customer(s) or client(s) rely on such written report or written opinion, resulting in “damages” arising from “pollutants”.

Please review exceptions (i) and (ii) of this exclusion which provide coverage for the professional services rendered by testing laboratories who are called upon to sample, test, analyze and report on materials which contain pollutants.
Coverage is not provided for the testing laboratories’ own potential environmental liability for the exposures due to its operation (such as storing and utilizing chemicals, and generating waste, in performing testing services) that is separate and distinct from its liability exposure due to its performance or professional services in the environmental area.

“Prior Acts” Coverage is provided for Insureds who have carried continuous professional liability insurance. For other eligible applicant’s, “prior acts” coverage is available at an additional premium.

LIMITS OF LIABILITY
Up to $2,000,000 (each claim) / $2,000,000 (annual aggregate for all claims). This limit is inclusive of all legal, investigative, and defense costs. Higher limits available via our Excess Professional Liability Facility.
MINIMUM PREMIUM $3,000

SPECIAL NOTES
| This facility is offered to eligible insurance brokers on a surplus lines basis in all states. Brokers are responsible for filing appropriate forms and collection and payment of surplus lines tax in the state. |
