COVERAGE HIGHLIGHTS

The general overall scope of an environmental consultant’s services is to determine what had been disposed of in the past in an environmentally unsound method, where the disposal occurred, the extent of the disposal, the extent of the impact of the disposal and to develop or propose means and methods of remedying the condition found.

Our proposed program for Environmental Consultants targets professionals involved in environmental risk assessment and consulting is areas such as:

1. Pre-acquisition of real estate assessment.
2. Site assessment.
3. Groundwater contamination assessment.
4. Surface and subsurface investigations.
5. Site history compilation.
6. Site reconnaissance.
7. Sampling and/or monitoring of surface waste and groundwater.
8. Sampling and/or monitoring of soil, sediment and air.
9. Assessment of potential liability. 10.Recommendation of necessary remedial action. 11.Environmental permit preparations. 12.Tank consulting. 13.Asbestos consulting in the areas of the detection or existence of asbestos.

Our program will extend to environmental consultants involved in remediation work, hazardous material management and consulting or property restoration and remediation. Our underwriting intent is not to provide coverage to environmental consultants who would fall into the broad gambit of a response action contractor (“RAC”).

COVERAGE FOR SPECIFIED SERVICES

The coverage offered will extend only to those specified professional services which will be listed in our quotation letter. These are specified “professional services” which will be shown in the Declarations Page of the policy when issued. Please review these carefully with the Applicant when discussing the coverage offered under our facility.

You will note that the coverage does extend to these environmental consultants who are called upon to advise their clients concerning the detection or existence of asbestos. We request that you review Exclusion II of the policy.

You will also want to review the Pollution Exclusion III of the policy with your client. Coverage is not afforded to environmental consultants who are involved in superfund assessments and remediations or in connection with actual, alleged, or threatened discharge of release of pollutants.

Also, the policy does not provide coverage for the Insured’s direct involvement in pollution claims by any government or regulatory body. The intent is to provide coverage to the Insured for claims by an owner or user of the Insured’s services, for direct property damage losses to them as a result of the Insured’s failure to detect the presence of pollution, resulting in cleanup cost or financial loss. The financial loss would be in the diminution in value of the property due to the Insured’s negligent services.

Firms whose professional services also include civil engineering involving HVAC systems, electrical systems, waste water, sewage and potable water systems would be eligible for coverage under our facility and the Exclusion III of the policy can be extended to have this exclusion amended to include coverage for these professional services.

It is noted that a number of environmental consultants perform their own laboratory professional services. The intent is to cover the environmental consultants with regard to the negligent performance of these professional services; however, the laboratories and equipment are not covered. The application requires that, in the event these professional services are provided, the Applicant must have commercial general liability coverage in place.

POLICY HIGHLIGHTS

A) Covers Named Insured and employees of the Named Insured while acting within the scope of their duties.
B) “Prior Acts” Coverage is provided for Insureds who have carried continuous professional liability insurance. For other eligible applicant’s, “prior acts” coverage is available at an additional premium.
C)Broad Policy Form.

LIMITS OF LIABILITY

Up to $2,000,000 (each claim) / $2,000,000 (annual aggregate for all claims). This limit is inclusive of all legal, investigative, and defense costs. Higher limits available via our Excess Professional Liability Facility.

SPECIAL NOTES

This facility is offered to eligible insurance brokers on a surplus lines basis in all states. Brokers are responsible for filing appropriate forms and collection and payment of surplus lines tax in the state.
