A&E PROGRAM HIGHLIGHTS
The policy provides broad coverage on a CLAIMS MADE BASIS for:
for Wrongful Acts arising out of described Professional Services rendered anywhere in the world provided the Claim is first made against the Insured in the United States, its territories or Canada.
Professional Services defined to mean those services provided by the insured acting in the capacity of an architect, engineer, landscape architect, interior designer, land surveyor, construction manager, environmental consultant or as specifically listed in the policy.
Policy also provides prior Wrongful Acts coverage for such Acts committed prior to the inception date of the policy but after any Retroactive Date shown, provided the insured had no knowledge of such Acts at inception and there is no other insurance available to the Insured.
Coverage is provided for the Named Insured listed in the policy and includes coverage for any past or present officer, director, partners and employees while acting within the scope of his/her duties for the Named Insured.
Coverage is provided for insured’s liability arising out of Wrongful Act in any joint venture in which the insured participates.
Coverage is not excluded under the policy for Professional Services rendered for another entity in which the Insured has ownership interest of 25% or less.
If during the policy period, the insured becomes aware of a circumstance, fact, event, or situation which may subsequently give rise to a Claim being made against them and gives written notice to the Insurers of this Circumstance, any Claim which is subsequently made against the insured is treated as a Claim under the policy.
If the Insurers cancel or refuse to renew the policy, the insured has an option to extend coverage for 365 days from the date of cancellation or non-renewal by payment of 100% of the annual premium provided this option is exercised within 30 days after date of cancellation or non-renewal.
Definition of the term Damages under the policy includes punitive damages but only if insurable by law under which the policy is construed.
We are now providing supplementary payments to the Insured as per Insuring Agreement I.D. of the policy wording: A. Defendant’s Reimbursement – At Insurers’ request, the Insured shall attend mediation/arbitration proceedings, hearings, depositions, and trials relative to the defense of a Claim. After three days of attendance, Insureds shall pay the Insured $500 per day up to a maximum of $5,000. B. Regulatory/Administrative Actions Reimbursement – the Insured will be reimbursed up to $15,000 for legal fees and expenses incurred in responding to a regulatory or administrative action brought directly against the Insured by a governmental agency under ADA, FHA, or OSHA. Please note, coverage applies only if arising from a covered professional service and if reported during the policy period and Insurers have given written consent. C. Disciplinary Proceedings – the Insured will be reimbursed up to $10,000 for legal fees and expenses incurred in responding to a disciplinary proceeding brought directly against the Insured. Please note, coverage applies only if arising from a covered professional service and if reported during the policy period and Insurers have given written consent.
Per Section II, we are now providing pure worldwide coverage. Our old form required that the suit or action be brought in the U.S.
Per Section XIII, we are now providing a bi-lateral extended reporting period option. Our old form only offered a unilateral extended reporting period option if coverage was cancelled or non-renewed by the Insurer. $250K Sub-limit EPL option (indemnity and defense) available subject to our supplemental application for additional premiums starting at $1,100.
